These terms apply to the Tally on Cloud service sold on this website under the brand Tally Cloud India, operated by Hosting Safari Pvt Ltd ("we", "us"). By creating an account, ticking the agreement boxes at checkout or paying for a plan, you ("you", "the customer") agree to them. A copy of the version you accept is emailed to you after payment.
1. The service
We provide a Windows cloud server on which you run TallyPrime. You open it through your browser or the Remote Desktop app using the login shown in your customer portal. Plans are priced per user per month, as shown on the plans page at the time you pay.
2. Who can buy
You must be at least 18 years old and buying for yourself or for a business you are allowed to represent. Information you give us, including company and GST details, must be true and kept up to date.
3. Identity verification (KYC)
Indian rules require us to know who uses our servers. You must complete KYC through DigiLocker, or through our team where DigiLocker is not possible, before your login is shown. We may refuse or stop service if KYC fails or the details do not match.
4. Prices, GST and invoices
- Prices are in Indian Rupees and exclude GST, which is added at checkout at the applicable rate (currently 18%).
- A tax invoice is issued for every payment. If you enter a valid, active GSTIN at checkout, it is printed on the invoice.
- We may change prices for future billing periods. We will tell you before a change applies to your renewal.
5. Payment and renewal
- You pay in advance for the billing period you choose (for example 1, 3, 6 or 12 months).
- Payments are processed by Razorpay. We do not see or store your card or bank details.
- Your service runs until the renewal date shown in your portal. Renew before that date to avoid interruption.
6. Late payment and suspension
If a renewal is not paid by the renewal date, we may suspend access. Your data is kept for a maximum of 3 days after suspension. After that it is permanently deleted and cannot be recovered. Pay the renewal within those 3 days and access is restored.
7. Data backup is your responsibility
- You alone are responsible for backing up your data. This includes your Tally company data and any other files you keep on the server.
- You must take a backup every day and keep it on a system you control, such as your own computer, an external drive or a separate cloud storage account.
- You must check every day that your latest backup is complete and can be restored. A backup that has not been checked should not be relied on.
- Any backups we take on our side are a convenience to help with recovery. They are not guaranteed, they are not a replacement for your own backups, and they may not be complete or available when you need them.
- To the maximum extent permitted by law, Tally Cloud India and Hosting Safari Pvt Ltd are not responsible for any loss, corruption, encryption or unavailability of your data, or for any loss that results from it, whatever the cause. This includes ransomware or other malware, hacking or cyber attack, data corruption, hardware or software failure, power failure, human error, fire, flood, earthquake or any other natural disaster, and any event beyond our reasonable control.
- By accepting these terms you confirm that you have read this section and that the risk of losing data rests with you.
8. Your other responsibilities
- Keep your logins private and share them only with the number of users you pay for.
- You need a valid TallyPrime licence for the server unless your invoice says a licence is included.
- Change the temporary password after your first login.
9. Things you must not do
You must not use the server for anything unlawful; send spam; attack, scan or try to break into any system; mine cryptocurrency; install software you are not licensed to use; or try to reach other customers' servers or data. We may suspend service immediately if we see any of these.
10. Your data and privacy
Your company data in Tally belongs to you. We do not open, read or share it except to fix a problem you have asked us to fix, or where the law requires it. How we handle personal information is explained in our Privacy Policy.
11. Availability and support
- Uptime commitment: we commit to 99.00% uptime for your Tally cloud server, measured by our server monitoring. Uptime does not count planned maintenance announced in advance, problems on your side (your internet connection, devices, or software you installed on the server) or events beyond our reasonable control.
- If you believe your server was down, send us the date, start and end time of each outage and any error messages. Our IT team checks this against our monitoring logs, and the result of that check is final for deciding any remedy. The remedies for downtime are those in the Refund Policy.
- There can be planned maintenance and unexpected outages. We will try to give notice of planned work.
- Support hours: Monday to Saturday, 9:30 AM to 7:00 PM (IST). Support is closed on Sundays and national holidays. Tickets and messages received outside these hours are answered on the next working day.
- Support is available through tickets in your portal and on WhatsApp.
12. Cancellation
You can stop renewing at any time from your portal or by raising a ticket. Refunds follow our Refund Policy. Before your service ends, you can ask us to export your Tally data.
13. Limit of liability
To the extent the law allows, we are not liable for indirect or consequential loss, such as lost profit or business. Section 7 applies to any loss of data. Our total liability for any other claim is limited to the amount you paid us for the service in the three months before the claim.
14. Record of your acceptance
When you accept these terms we keep a record of the version you accepted, the date and time, your IP address and your browser details, linked to your account and order. This record may be used as evidence of your agreement, including before a court or other authority.
15. Changes to these terms
We may update these terms. Each update gets a new version number. The version you accepted applies to the billing period you paid for; the latest version applies from your next renewal.
16. Law and disputes
These terms are governed by the laws of India. Courts in Delhi have jurisdiction over any dispute.
